Agreement

I (we) agree that the club holding these events has the right to refuse this entry for cause which the club shall deem sufficient. In consideration of the acceptance of this entry and of the holding of these events and of the opportunity to have the dog judged and to win prizes, ribbons, or trophies, I (we) agree to hold the AKC, the event-giving club, their members, directors, governors, officers, agents, superintendents or event secretary and the owner and/or lessor of the premises and any provider of services that are necessary to hold these events and any employees or volunteers of the aforementioned parties, and any AKC approved judge, judging at these events, harmless from any claim for loss or injury which may be alleged to have been caused directly or indirectly to any person or thing by the act of this dog while in or about the event premises or grounds or near any entrance thereto, and I (we) personally assume all responsibility and liability for any such claim; and I (we) further agree to hold the aforementioned parties harmless from any claim for loss, injury or damage to this dog.

Additionally, I (we) hereby assume the sole responsibility for and agree to indemnify, defend and save the aforementioned parties harmless from any and all loss and expense (including legal fees) by reason of the liability imposed by law upon any of the aforementioned parties for damage because of bodily injuries, including death at any time resulting therefrom, sustained by any person or persons, including myself (ourselves), or on account of damage to property, arising out of or in consequence of my (our) participation in this event, however such, injuries, death or property damage may be caused, and whether or not the same may have been caused or may be alleged to have been caused by the negligence of the aforementioned parties or any of their employees, agents, or any other persons. I (WE) AGREE THAT ANY CAUSE OF ACTION, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATED TO THE ENTRY, EXHIBITION OR ATTENDANCE AT THESE EVENTS BETWEEN THE AKC AND THE EVENT-GIVING CLUB (UNLESS OTHERWISE STATED IN ITS PREMIUM LIST) AND MYSELF (OURSELVES) OR AS TO THE CONSTRUCTION, INTERPRETATION AND EFFECT OF THIS AGREEMENT SHALL BE SETTLED BY ARBITRATION PURSUANT TO THE APPLICABLE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. HOWEVER, PRIOR TO ARBITRATION ALL APPLICABLE AKC BYLAWS, RULES, REGULATIONS AND PROCEDURES MUST FIRST BE FOLLOWED AS SET FORTH IN THE AKC CHARTER AND BYLAWS, RULES, REGULATIONS, PUBLISHED POLICIES AND GUIDELINES.

By agreeing, I (we) certify that Junior Handlers do not now, and will not at any time, act as an agent/handler for pay while continuing to compete in Junior Showmanship.

Entries for Junior Handlers should be sure to enter the Junior Handler number into the entry form. Should you not have your Junior Handler number, it may be obtained from the American Kennel Club (919) 816-3776. If the Junior Handler is not the owner of the dog identified on the face of this form, the relationship of the Junior Handler to the Owner should also be noted on the form.

I (we) agree that the owners and operators of TrialToaster.com are not responsible in any manner for direct, indirect, special or consequential damages, however caused, arising out of my (our) use of this Website, any web browser or any Internet connection, apparatus or software used in the connection or communication with this Website or its constituent elements or persons, including any damages suffered when transmitting confidential or sensitive information to this Website or if the Website communicates such information to others.

I (we) understand that an entry fee is like an airplane ticket or hotel reservation in that the reservation is made and a fee is paid, but it is my (our) responsibility to show up. If someone does not show up for their flight, the airplane leaves without them. If I (we) do not show up for the event after entering the trial, the event will go on without me (us) and I (we) are not entitled to a refund. Further, since this is a competition, if I (we) do not win or place in the competition or decide that the trial is not exactly to my (our) liking, much like a bumpy ride in the airplane, I (we) will have still participated in the competition and having done so, will have gotten that for which I (we) have paid and will not be entitled to a refund.

I (we) agree to pay all charges incurred at this Website as a part of Fees and if a refund is expected for any reason I (we) will first seek such refunds from the event secretary or club hosting the event, even if such refund is created by my (our) use of browser "back" and "refresh" functions which I (we) have been here warned not to use.

I (we) understand that if, for any reason, the Event Secretary does not comply with my (our) legitimate refund request I (we) may ask TrialToaster.com directly for the refund. If the refund is due according to this agreement and these agreed upon terms, then a refund will be issued within 30 days after the end of the trial. I (we) understand that all unlawful charge-backs will be prosecuted to the full extent of law and unfair charge-backs will be billed to me (us) in the exact same manner as a bounced check would be and will be treated as such. I (we) also understand and agree that non-payment for entry fees and/or charge back fees, if deemed to be in violation of this agreement, will be dutifully reported to the AKC and disciplinary action will be requested which may effect my (our) ability to show dogs in the future.

I (we) understand that in addition to the entry fees charged by the event holding club, a $3 per first entry and $2 per subsequent entry for the same dog in the same credit card transaction in each event will be added as the administration fee for TrialToaster.com and such fee is non-refundable.

Handlers may opt to enter in a higher height division for all Regular titling classes, but not in a division lower than their proper height division. Dogs entered in the Preferred classes must compete at the required jump height and may not compete in a jump height division higher or lower than their proper height division.

All dogs that have not been officially measured for an Agility Jump Height Card may still compete; however, they must be measured by a Judge of record, an Agility Field Representative, or a Volunteer Measuring Official, prior to running. If measured by the Judge of record, that measurement will be valid for this trial or back-to-back trials only. If a measurement is necessary, it is the exhibitor's responsibility to have their dog(s) measured prior to running.

Mixed breed dogs may be eligible to enter all-breed AKC agility trials at the club's option. Mixed breed dogs entered in these events must list the breed name as "Mixed Breed" and not as a breed hybrid and must include their AKC Canine Partners number on the entry form and select the appropriate registration type.

There may be further Notices and Instructions on the printed premium list for any event for which TrialToaster.com accepts online entries. All Terms, Conditions, Notices and Agreements printed upon the AKC Official Entry Form and Premium List for any trial which uses TrialToaster.com services is hereby made a part of this agreement. It is your responsibility to find and read those premiums before entering the event.

I (WE) CERTIFY that I am the actual owner of the dog, or that I am the duly authorized agent of the actual owner whose name I have entered above. In consideration of the acceptance of this entry, I (we) agree to abide by the rules and regulations of The American Kennel Club in effect at the time of this event, and by any additional rules and regulations appearing in the premium list for this event, and further agree to be bound by the "Agreement" shown above and on any and all official printed entry premiums and entry forms. I (we) certify and represent that the dog entered is not a hazard to persons or other dogs. This entry is submitted for acceptance on the foregoing representation and Agreement. I (we) agree to conduct myself (ourselves) in accordance with all such Rules and Regulations (including all provisions applying to discipline) and to abide by any decisions made in accord with them.
